Which certification does your tender require? CE, FDA and MENA registration

Short answer

CE marking and FDA clearance are approvals within their own jurisdictions, and neither substitutes for the other: the FDA does not recognise foreign regulatory approvals, and CE marking does not satisfy FDA requirements. Neither replaces local registration. Saudi Arabia requires an SFDA marketing authorisation, the UAE requires MOHAP registration, and most MENA markets require a locally licensed representative.

The mistake that costs tenders

A supplier offers a device and states that it is "CE certified", and the buyer treats that as the end of the regulatory question. It is not. CE marking tells you the manufacturer has declared conformity with the applicable European legislation for sale in the European market. It says nothing about whether the device may legally be sold, imported or installed in the country running the tender.

The three questions are separate, and a complete tender answer needs all three: is the device approved where it was made, is it registered where it will be used, and is there a licensed local entity accountable for it.

What CE marking and FDA clearance each certify

CE marking is a declaration of conformity with European legislation, made by the manufacturer and, for higher-risk devices, assessed by a notified body. It is what allows a device onto the European market.

FDA clearance or approval is the United States equivalent, through a premarket notification or a premarket approval depending on the device class, with its own establishment registration and device listing obligations for importers.

They are not tiers of the same ladder and neither is "stronger". They are two jurisdictions, and the FDA does not recognise regulatory approvals issued by other countries.

Local registration is a separate requirement, not a formality

In Saudi Arabia, every medical device sold requires a Medical Device Marketing Authorisation from the SFDA. The MDMA route requires a full technical file assessment regardless of whether the device already holds CE marking or FDA clearance — prior approval is supporting evidence, not a shortcut.

In the UAE, devices must be registered with MOHAP before sale or distribution. The review verifies prior approvals such as CE or FDA as part of the dossier, and the manufacturing site must be registered first, with a valid ISO 13485 certificate. A foreign manufacturer must appoint a locally licensed authorised representative, and there must be a licensed local importer.

Elsewhere in MENA the pattern repeats with local variation: national ministry of health registration, a licensed in-country representative, and documentation that traces the device from manufacturer to installation. Confirm the current requirement with the authority itself before a tender closes — these regimes change, and a guide is not a substitute for the regulator.

What a tender document should actually ask for

Asking for "CE or FDA" and stopping there is how a compliant-looking bid becomes an undeliverable contract. A specification that can be enforced asks for each layer separately.

The approval itself
The certificate or clearance, naming the device and model, with the issuing body and its validity dates — not a general company statement.
Local registration
Proof the device is registered in the country of use, in the name of an entity that can lawfully supply it there.
The chain to the manufacturer
A procuration, authorised distributor letter or equivalent showing the bidder is entitled to supply that manufacturer’s product — and that warranty and spares follow from it.
Quality system evidence
ISO 13485 for the manufacturing site is a standard expectation and is explicitly required in some registration routes.
Who is accountable after delivery
Installation, training, calibration, spares and the named party responsible for each. Regulatory paperwork does not commission a device.

Common questions

Is a CE marked device automatically accepted by the FDA?
No. The FDA does not recognise regulatory approvals issued by other countries, and CE marking does not satisfy FDA requirements. A device intended for the United States market needs its own FDA clearance or approval.
Does CE marking or FDA clearance speed up SFDA registration?
It supports the file but does not replace it. The SFDA marketing authorisation route requires a full technical file assessment whether or not the device already holds CE marking or FDA clearance.
Why does a hospital need a local representative if the manufacturer is reputable?
Because registration regimes require an accountable entity inside the country, licensed to supply, and because warranty, spare parts, calibration and post-market reporting all have to route through someone locally reachable. Reputation is not a regulatory status.
